The US Supreme Court has accepted Donald Trump’s appeal on the issue of the ex-president’s immunity from prosecution. The Supreme Court announced that a hearing on this will take place from April 22. The decision is a success for Trump.
The move makes it unclear if and when the former president’s trial for attempted election fraud could begin in Washington. Trump’s lawyers are trying to delay the possible start of the trial.
Trump is being charged in the US capital Washington in connection with attempted election fraud. Trump supporters stormed the Houses of Parliament in Washington on January 6, 2021. Congress met there to formally confirm Democrat Joe Biden’s victory in the presidential election.
Trump had previously incited his supporters during a speech. Five people were killed as a result of the riots. Before the storming of the Capitol, Trump had already attempted to overturn the election results at various levels. He still does not acknowledge his defeat against Biden and wants to move back into the White House after the presidential elections in November.
Is the American President above the law?
Trump and his lawyers want the charges dropped. They invoke Trump’s immunity in his office as president at the time. He could not be legally prosecuted for actions that were part of his duties as president. They most recently failed with this argument before an appeals court in the US capital in early February. This ruled that the 77-year-old Republican could be prosecuted for his actions during his term of office. Trump has taken legal action against this decision in the Supreme Court.
The Supreme Court has now announced that it will consider “whether, and if so, to what extent, a former president enjoys immunity from criminal prosecution for conduct allegedly related to official actions during his term of office.”
A judgment has a huge impact
Both parties will present their positions during the hearing. It will probably take several weeks before the court makes a decision. The decision on protection from criminal prosecution is also of enormous importance for future presidents. If they truly enjoy immunity, they could commit crimes while in office without fear of consequences. But it remains to be seen what exactly the Supreme Court’s ruling will be.
The judge in charge of the election fraud case had postponed the start of the trial indefinitely until the issue of immunity was finally clarified. The trial was actually supposed to start on March 4.
