Now in court – Tyrol: Rabid couple attacked the park ranger

A Tyrolean couple (41 and 31 years old) became quite violent last year in the Tyrolean town of Ausserfern when a parking attendant wanted to fill out a parking ticket. Both appeared at the Innsbruck Regional Court on Thursday.

The incident that led to the accusation of resistance to state power took place in Reutte in mid-October last year. On that day, the 41-year-old stopped his car somewhere between the cycle path and the parking lot. The parking attendant warned him about this. A tumultuous situation then arose, which a witness also confirmed.

There should have been no “threat”.
The park ranger asked the man to keep his distance from her. The 41-year-old allegedly threatened that he would “give her some distance” and that she would “take one out” straight away. He didn’t deny it at all during the trial, but still pleaded not guilty. “It wasn’t a threat, judge,” he emphasized several times.

His wife (31) admitted at least partial guilt and was remorseful. She couldn’t remember exactly what had happened. She thinks she just “waved her hands wildly” and possibly accidentally hit the ticket pad.

The parking attendant saw it differently: “The woman definitely pushed me and jerked back my hand in which I was holding the penalty block.” The threat from the first defendant was also clear to her. “I was really scared then.”

Some rulings are not yet legally binding
This is how the public prosecutor saw it: ‘It does not matter what the sender means, but how it is received by the recipient.’ Objectively speaking, it was undoubtedly a threat. The judge also followed this judgment and legally did not sentence the man to a semi-suspended fine of 880 euros. A diversion ban and a fine of 1,500 euros were imposed on his wife.
