He did not have a residence permit or a work permit. Nevertheless, an Albanian was employed by a German construction company. His work was discovered during an inspection last year, the worker was taken into custody awaiting deportation and deported back to his home country. His former employer must now bear the costs.
The responsible district of Bad Kreuznach in the state of Rhineland-Palatinate sent the company an invoice for approximately 5,850 euros. The Albanian’s former employer appealed and the case went to trial.
The administrative court in Koblenz has now decided that the claimant is liable for the costs of removing the child from the country. The reason: the Albanian would not have been allowed to work due to his illegal stay. In such a case, the Residence Act stipulates that the authorities shall bear the resulting costs.
The workers missed the deadline to leave the country
The construction company claimed in court that the set deadline for leaving Germany could not be met due to an acute stomach illness that required hospital treatment. After his treatment, the man actually went to the airport. However, the district refuted this and emphasized that the Albanian did not have a valid plane ticket and only had a fanny pack with him.
The decision of the Koblenz Administrative Court can be appealed within one month.
