The Basque government will try to transfer the blame for the works on the landfill to Verter Recycling

Asked about the deadlines it uses to recover said public funds, the department headed by Arantxa Tapia points out that “it is not possible to make a prediction, as they depend on the outcome of the various actions that started for such purposes.”

The Ministry of Economic Development, Sustainability and Environment has requested the Ministry of Economy and Finance to take appropriate measures with regard to the enforcement of the 28.7 million that Verter Recycling owes the Basque government for the search for the two buried workers and the stabilization carried out at the Zaldibar landfill, as well as for the possible settlement of the debt owed to the managers and administrators of the company.

In a response from the Ministry of Economic Development, Sustainability and Environment to a question from Elkarrekin Podemos-IU, it recalls that by resolution of February 18, 2022 of the Deputy Minister of Environmental Sustainability, Verter Recycling was obliged to liquidate, in his capacity of the operator of the installation and are obliged to pay the costs incurred, the payment of costs related to the provisional measures implemented directly by the Basque Government to prevent and avoid new environmental damage and to guarantee human health as a result of the landslide and subsequent fire occurred at the Zaldibar landfill.

On March 21, 2022, the company in liquidation lodged an appeal against the aforementioned Decree of February 18, 2022, an appeal that was rejected by decision of the Minister of Economic Development, Sustainability and the Environment of March 25, 2022.

Once the voluntary payment deadline established by Decree 1/2021 of January 12, approving the collection regulation of the General Treasury of the Basque Country, has expired, without proceeding with the above payment, the Ministry of Economic Development, Sustainability and Environment has requested the Ministry of Economy and Finance to take the necessary measures regarding the enforcement process, as well as the possible diversion of blame to the managers and trustees of the company.

Asked about the deadlines by which the Basque government manages to recover these public funds, the ministry headed by Arantxa Tapia points out that “it is not possible to make a prediction regarding the deadlines in which the costs borne by the Basque government after the dumping of the landfill will be recouped, since they depend on the outcome of the various actions launched for such purposes”.

Finally, the Basque government confirms that it is not responsible for issuing a ruling on whether the liquidation of a company that is in legal proceedings is legal or not, “since this is a matter that corresponds to the jurisdiction”.
