In May 2023, an eight-year-old was dragged into the bushes by a then 17-year-old while playing in Vienna’s Vogelweidpark. According to the Public Prosecution Service, the mentally disabled perpetrator tried to rape the child. The boy was able to free himself with a blow to the stomach. The Viennese Landl imposes a suspended prison sentence and an unconditional fine on the reasonable defendant.
At first glance you cannot say that the tall, stocky man has an intellectual disability. But the 18-year-old, who is now in the care of his father, barely answers the judge’s questions and remains silent even on simple questions.
“It must be combated immediately”
After his assessment, forensic psychiatrist Peter Hofmann confirmed that the perpetrator had reduced intelligence, but considered the young man to be healthy. “He needs appropriate treatment and medication. It is important that countermeasures are taken immediately,” says Ms Rat from the expert report. According to the lawyer, his client is already receiving therapy. The suspect is embedded in a daily structure at “Jugend am Werk”.
What the defendant is accused of is every parent’s nightmare. On May 9, 2023, in broad daylight in the Vogelweidpark in Vienna’s 15th district, he pulled an eight-year-old boy into the bushes and groped him. He tried to pull down the boy’s sweatpants and attempted to perform sexual acts on him. With a courageous blow to the perpetrator’s stomach, the child managed to free himself and ran crying to his mother, who was already looking for her son in the park: “He hurt me,” the boy sobbed.
500 euros in compensation for the eight-year-old
The Vienna public prosecutor’s office charged the young person at the time of the crime with attempted rape and attempted serious sexual abuse of minors. In the courtroom, the Viennese says silently: “I am guilty.”
The jury sentenced the previously innocent man to an eight-month suspended prison sentence and to 120 daily rates of four euros each. In addition, instructions for therapeutic measures were given. The father accepts the compensation of 500 euros demanded by the victim representative.
