Fatal accident – Even an alcoholic driver is not automatically guilty

Even being drunk doesn’t have to be an admission of guilt: A 15-year-old moped driver died in Tarsdorf after a collision with a drunk man’s car. The steering wheel had an alcohol content of 1.4 per mille. Now it is determined who is responsible.

A tragic traffic accident took place in the Innviertel on Sunday evening: As reported, a 15-year-old resident collided with a car on his moped in Tarsdorf. Although two police officers witnessed the accident and immediately resuscitated the boy, he died in hospital that same night from his serious injuries. The driver of the accident was under the influence of alcohol: the 34-year-old had approximately 1.4 per mille. His driver’s license was confiscated on the spot.

Still subject to research
Whether he was also responsible for the accident is still being investigated: “We have to see whether the driver was not only drunk, but also made a mistake, that is, whether he drove on his side of the road or in the middle. ” explains Alois Ebner from the public prosecutor’s office in Ried im Innkreis. “The fact that he was under the influence of alcohol is not enough to prove him guilty; it must be proven that he breached his due diligence.”
Up to three years in prison possible
If investigators succeed, the 34-year-old would have to answer for murder by gross negligence, which carries a prison sentence of up to three years. According to initial information, the 15-year-old narrowly passed the oncoming patrol car before crashing seconds later.

Moped accidents are common
Moped accidents are common and often end in fatalities: According to the Austrian Transport Club (VCÖ), there were no fatal moped accidents in Upper Austria in 2023, but in the previous year 701 people were injured and five died. In 2021, there were 767 injuries and four deaths in moped accidents. “The chance of accidents with a moped is high. A good supply of public transport could prevent many serious accidents among young people,” says VCÖ spokesperson Christian Gratzer.
