A 43-year-old was not legally sentenced by the Klagenfurt Regional Court on Tuesday to a fine of 3,800 euros and a four-month suspended prison sentence for torturing his ex-partner’s three children. According to the complaint, the children were forced to starve, stood in the corner for hours and suffered threats and abuse.
The Graz Higher Regional Court had annulled the 43-year-old’s diversion because there was insufficient evidence of guilt and the guilt was serious. In the new trial, the Carinthian, who according to the judge himself had had a difficult childhood, pleaded guilty to the criminal charges, but said he had “merely complained”.
The boy threatened that he would have to smoke a cigarette
When asked, he admitted that he had occasionally had a ‘tapperle’ on a child’s head. He was stressed because of his work. In fact, it is said that much more happened. The suspect once threatened one of the boys that he would have to smoke an entire pack of cigarettes until he threw up. That is not true, according to the suspect.
Mother would have looked away
The distraction for the children’s partner and mother, who was originally in the courtroom with the suspect, was not lifted. She would not have used violence, but would have looked away. The 43-year-old has not had contact with the children for two years, which he says hurts him. After the verdict was handed down, judge Gernot Kugi warned him: “Never show such behavior towards a child again!” The children – now aged 13 to 16 – received compensation of 500 euros each, of which they have already received 100 euros! part of the diversion.
Defendant accepted the guilty plea
The 43-year-old accepted the guilty plea for torturing or neglecting minors, young people or defenseless people; the prosecutor gave no explanation. The judgment is therefore not legally binding.
