In Kassel, a young German (21) has now been sentenced to more than eleven years in prison for the murder of a student (14). He must serve his sentence in a social therapy institution under preventive detention because, according to the court, he may have a tendency to commit serious crimes.
As reported, the victim was found dead on September 28, 2023 on the side of a dirt road in Bad Emstal (Kassel district in Hesse). A man found the body of the 14-year-old, who was already missing, while making wood and immediately called the police. The investigation revealed that there was malicious intent and that led to a then 20-year-old acquaintance of the victim.
Student sexually touched and photographed
Now the Kassel Regional Court ruled that the young man with German citizenship had strangled his acquaintance to obtain sexual gratification. He then allegedly touched the girl’s corpse in a sexually motivated manner and filmed and photographed it (see video above). The judgment is that he thereby disturbed the peace of the dead.
The German admitted in court last week that he had strangled the teenager until she lost consciousness after he got into an argument with her. According to his own statement, he did not want to kill her. In addition, the 21-year-old admitted to undressing the victim and making film and video recordings of her. This should have deterred her from reporting the incident to the police.
Because the suspect was twenty years and eleven months old at the time of the crime, a juvenile chamber of the Kassel Regional Court was responsible for the case. She decided that the young man would be sentenced under adult criminal law. This was justified, among other things, by the fact that he had already led a self-determined life. Moreover, a psychiatric expert had stated that the suspect was fully responsible.
The defense lawyer argued for manslaughter
The lawyer had argued for juvenile justice and a conviction for manslaughter. He considered a prison sentence of less than ten years appropriate. In reality it was eleven years and nine months. “The sentence should be carried out in a social therapy institution,” he said. The court also ordered the remand of preventive detention.
The verdict is not yet legally binding.
