“Mourning process” – toddler drowned in the swimming pool: distraction for parents

A year after the terrible accident in which a one-year-old boy fell into a swimming pool and drowned, the parents in Carinthia had to appear in court. The two were given a diversion at the Feldkirchen court. This means: You must pay 180 daily rates of four euros each (720 euros in total), plus the procedural costs.

The hearing before Judge Irene Malle-de Cillia lasted just fifteen minutes: “Let’s get this over with as quickly as possible,” she initially told the parents charged with negligent homicide.

The boy was unattended for only five minutes – that was enough for the toddler to get through the open patio door to the unsecured pool and fall in. ‘Both of you have already been sentenced to life in prison. “The state doesn’t necessarily have to do it again,” the judge explained.

The accident happened due to negligence “as it happens to us every day, but with such a terrible consequence that you now have to learn to live with.”

“I can only wish you the very best”
The diversion consisted of a fine of 180 daily rates of four euros each – due to the low income on the one hand and the care obligations on the other. In addition, there are 160 euros in fixed costs and 1,368 euros for an expert. “I can only wish you the very best,” the judge concluded the hearing. “Give yourself time for this grieving process.”
