Immature, therefore witness – boy (13) rudely to the judge: “Do I speak Latin?”

While other children go to school, several 13-year-olds are involved in a robbery case. A short man with loose trousers who has yet to break his voice is the main perpetrator of the crime in Vienna. Because he is a minor, he is only a witness in the trial of his 14-year-old accomplice – and turns out to be brutal and disrespectful.

On July 8, three boys aged 13 and 14 called their ‘school friends’ to Simmering with an excuse. They meet the quartet on the tram. The youngest grabs one of the four 13-year-olds by the neck and forces the victims to get out. The 13-year-old pulls out a knife, the suspected 14-year-old holds a stun gun in his hand. “Hop so we can hear money,” the youngest allegedly threatened at gunpoint before collecting a mobile phone and a total of 40 euros.

It is he who, as a witness in the trial, which takes place despite the bomb threat in the Landl, causes more commotion than the defendant, who is defended by lawyer Ernst Schillhammer. The boy, who is estimated to be 1.60 meters tall and weighs 40 kilograms, amazes with his callous descriptions: “Okay, the truth is that I am the perpetrator. I threatened the victims with a knife and stole their mobile phones,” he says dryly, before pointing at the defendant and asking: “Why is he there? He has nothing to do with it.’ – ‘Did you want to buy a mobile phone that day?’ asks Mrs. Rat. The cheeky response: “I stole one. Why should I buy one?” And when he was asked sarcastically, “Do I speak Latin?”

The boy, from Afghanistan, lives in a shared apartment, just like the second 13-year-old accomplice. The witness, who also appears very childish, enters the courtroom wearing a dark hoodie with the words ‘Pro Fighter’ and a fighter pictured on it. He also smiles as he leaves the room.

“It is not clear what role my client played in the robbery,” Schillhammer intervenes. The boy himself states that he was just there, but that he did not threaten or take anything. Because of the incriminating victim statements, the jury sentenced him to a twelve-month suspended prison sentence. It is doubtful whether his 13-year-old companions have been reformed by their appearance in court.
