The Supreme Court of United States today has the protection of the right to abortionwhich has been in force in this country since 1973, in a decision that will allow each state to decide whether to maintain or prohibit it.
The ruling states that the Constitution “does not grant” this right and returns the power to enact abortion laws to the “people” and their “elected representatives”.
The decision published today reverses both the sentence known as Roe vs Wade49 years ago, which protected the right to abortion across the country, like another 1992 resolution, Planned Parenthood vs. Caseywhich reaffirmed such protections, but allowed states to set rules for the process.
“It is time to uphold the Constitution and return the issue of abortion to the elected representatives of the citizens,” Judge Samuel Alito’s ruling says literally in a sentence that also includes his design, filtered in the media in May.
The decision was reached by a majority of votes, with six votes in favor – albeit with a separate recommendation – and three votes against.
Those who voted for it maintain that they do not view abortion as a constitutional right, nor as a right backed by American “history or tradition.”
Furthermore, he believes that Roe versus Wade was “offensive foul” and “collide” with the Constitution itself. And he adds that the other decision that defended the right to abortion, Planned Parenthood vs. Casey, in 1992, “perpetuated” those mistakes.
As expected, the three progressive Supreme Court justices voted against this decision.
“With sorrow for this court, but especially for the millions of American women who have lost a basic fundamental right today, we disagree,” they have stated in the opposing view that they have jointly signed Stephen Breyer, Sonia Sotomayor and Elena Kagan
With today’s ruling, states that decide to do so can completely ban abortion on their territory. This is expected to mean that the United States will split in two, between the state where the voluntary interruption of pregnancy is possible and those who prohibit it completely.
