A man (53) now has to pay a fine of 3,000 euros for putting up a Christmas tree in front of a kindergarten in Hamburg. The reason: the tree shop operator had not received approval from management. She didn’t want a tree at all and reported it for trespassing.
The incident happened last year. Florian Schröder wanted to make preschoolers happy and, in a cloak and dagger campaign, set up the Christmas tree in front of the facility in the Lokstedt district of Hamburg – decorated and with presents.
However, he had made the calculations without the kindergarten’s guidance. According to the “Bild” report, she immediately called the police and reported Schröder for trespassing. The case ended up in court.
The management had deliberately not put up a tree
It is said that the management deliberately did not erect a tree and did not consent to its entry or erection. At the time, the kindergarten even sent an email to parents stating: “We as a team decided against this because we do not want to exclude any child and their faith – in the spirit of religious freedom.”
Schröder, who runs the online store pflanzenmich.de, countered in court that the manager had said she had nothing against Christmas trees but could not implement all the traditions. “We wanted to make children happy at Christmas and that is why we are now (…) in court. For us, a Christmas tree and bright children’s eyes are not a crime, but a sign of hope.”
The lawyers of the Hamburg court saw things differently and sentenced the man to a fine of 3,000 euros. Because Schröder has appealed, the Hamburg regional court will hear the case on Tuesday.
