The Sustainable Development and Natural Environment Area of the Barakaldo Municipal Council (Bizkaia) approved on Monday to start a sanction procedure against Gassen Oxinorte, with three months of closure at night, for a serious violation of the noise lawbecause of the annoying beeping noise the factory has been making since last August.
The sanction proposed by the area managed by Alba Delgado consists primarily of the temporary partial closure of the activity, consisting of the closure for a period of three months of the facilities that are the source of noise at night (from 11 p.m. to 7 a.m) and the payment of a fine of 11,800 euros.
The company now has 15 working days from the receipt of the notice to provide any allegations, documents or information deemed relevant, as indicated by the municipal area.
The start of the sanctions procedure has been approved after the research carried out by municipal technicians, with the support of Basque Government staff, who carried out the work weekly measurements outside the factory and analyzed the required documentation.
Moreover, the decision comes two months after it was approved in plenary. a motion for taking urgent action to address the problem.
In this sense, one of the measures was to stop the company’s production at night demands from affected neighborswhich, according to what they have reported, carry without being able to rest since the end of August.
The problem started after the company’s usual shutdown in the summer to carry out maintenance work. After start-up and despite Oxinorte’s work to acoustically insulate the factory, the residents of Lutxana are confronted with a constant whistling sound.
The mayor of Barakaldo, Amaia del Campohas assured that they will “use all the tools at our disposal, all the legal and judicial tools we have, to try to put an end to this problem as quickly as possible.”
