Woman was injured – now the first dog has to be “retrained”

That happened quickly. The new dog ownership law has been in force in Upper Austria since December 1 and the first court ruling has already been issued. A dog owner and her animal were sent for additional training, so to speak. The reason: the Great Dane had bitten and injured an applicant.

This summer, an applicant for a job as a cleaner was seriously injured by the dog during a job interview near Linz. The same dog had already slightly injured a small child at the end of last year. The Linz magistrate then issued an official notice stating that the dog was abnormal and ordered further measures.

Owner objected
The owner did not want to accept this and filed a complaint with the administrative court. She justified this by saying the victim’s reaction contributed to the dog becoming aggressive and therefore the injuries were “self-inflicted,” according to a news release.

Complaint rejected
However, based on the case documents, the administrative court now concluded that the complaint should be dismissed as unfounded and made it more specific on the basis of the recently amended Upper Austria. The measures under the Dog Husbandry Act 2024. The dog must be classified as striking because two physical injuries have occurred.

Strict requirements for the owner
The owner must therefore conduct a behavioral medical evaluation of her dog (including findings) and also provide proof that additional training has been successfully completed. The owner was also instructed to keep the dog – also in her own home and garden – in such a way that it does not endanger or even injure people. “Whether this is done by confining the dog, tying it up or using a muzzle can be left to the discretion of the dog owner,” said a statement from the administrative court.
