Unfair advertising? – Zirben-Zoff: Karinthian takes Red Bull to court

Daniel Abart is not afraid of big companies. On the contrary: he takes them to court. After the Carinthian pine manufacturer had already sued Amazon, it is now also taking action against the Red Bull Group in Salzburg. He is concerned about ‘fairness, transparency and consumer protection’, as he reveals to ‘Krone’.

Can the health properties of pine wood be advertised – without scientific evidence? The civil lawsuit filed by Carinthian entrepreneur Daniel Albart, whose company “Zirbelino” offers a wide range of pine wood products, revolves around this question. What Abart does not do when advertising its products: Attribute health-promoting properties to pine wood, such as lowering the heart rate. There is no scientific evidence for this yet.

“We are all about honesty”
It is precisely this type of misleading or unfair advertising that is a thorn in Abart’s side, as he has already been excluded from such advertising by a court in Germany. “For us it is about honesty, transparency and consumer protection,” the Carinthian emphasizes. The same rules should apply to everyone in economic competition – especially businesses. That is why he has already filed a civil lawsuit against Amazon, which is responsible for the content in the online shops. With initial success: the Villach court granted the “interim order”.

Now Abart has Red Bull in its sights: according to the lawsuit, subsidiaries of the Salzburg energy drink manufacturer unfairly advertised pine products. Therefore, the Carinthian also filed a lawsuit here and requested an interim injunction. The case was heard at the Salzburg Regional Court on Wednesday. No results so far.
