The ELA union has explained that it initiated the legal proceedings because it understood that the Basque government “has violated the fundamental rights of freedom of association and collective bargaining by unilaterally imposing working conditions”.
The TSJPV has admitted to handling the lawsuit brought by ELA against the Basque government for the approval of its 2025 budget project “without negotiating the terms of employment of 100,000 peoplefrom the public sector.
In a statement, the Abertzale union explained that it had initiated the legal proceedings because it understood that the Basque government had “violated the laws”. fundamental rights of freedom of association and collective bargainingby unilaterally imposing employment conditions, without negotiation with the unions.” “Ignoring what the law prescribes,” he assured.
The union denounced this in the first budgets of the new director of Imanol Pradales “They didn’t even call the union party to negotiate.” and recalled that they are budgets ‘which fix the salary increases of all public employees of the Basque governments, and in particular of the more than 100,000 public officials dependent on the Basque government, as well as other issues of access to public employment, of necessary bargaining by law”.
ELA has indicated that, despite the “strong opposition” from the Basque governmentwho wanted the appeal dismissed, the Administrative Dispute Chamber of the Supreme Court agreed to the union’s request.
As he noted, the legal proceedings of this lawsuit are now beginning and ELA will request that it be recognized that the Basque Government, following what is stated in the law, “should have negotiate in advance wages and working conditions in trade unions”.
According to the ELA, the Basque government’s actions have violated the right to freedom of association and collective bargaining, which must be restored by the executive power.
