The incident had already occurred in December 2023 and the agreement only followed a year later. Kylie Divon started working at the fast food chain in 2019. She initially identified herself as non-binary and changed in the women’s or men’s room.
A Muslim colleague felt disturbed
From 2020 onwards, she only wanted to be addressed as ‘she’ – in July 2023 she also informed her superiors about this and only wore women’s clothing. A few months later, the situation finally escalated when a Muslim colleague prevented her from entering the women’s locker room. She signaled to her with a wave of her hand that she didn’t care what she looked like from above, because it looked different from below. The colleague denied these accusations.

According to his own statement, the director did not support Divon, on the contrary: when she complained, he basically explained to her that a man remains a man. He would also not feel comfortable if someone used the men’s locker room “who felt like a man, but was clearly not a man,” the chairman quoted the accused branch manager as saying, according to the “Süddeutsche Zeitung”.
Discrimination, yes, but not a ‘hostile environment’
The judge ruled that the statement was problematic because it was discriminatory and denied the femininity of the person concerned. However, she doubted whether this justified compensation as requested by the plaintiff. To do this, it must be proven that “a hostile environment” has been created for those affected at work, which cannot be recognized.
