Following the lawsuit filed by the Steilas and Ehige unions against the decree establishing the criteria for the organization and planning of non-university education in the Basque Autonomous Community, the Supreme Court yesterday, Thursday, issued a ruling annulling it invalid.
Hours later, both Steilas and Ehige viewed yesterday’s ruling as positive. “It generates legal uncertainty, since the planning of the entire education system is based on this decree,” they have pointed out.
“We have heard that the Basque government will appeal the ruling. If she ultimately does so, we will consider applying for provisional enforcement of the judgment. In this sense, we ask the government to take the verdict and adhere to it, and not to prolong its implementation with sterile speeches and to elaborate a new planning decree that gives priority to the Basque public school.
The Ministry of Education, in turn, has defended the “appropriateness” of both the content of the decree and its processing and has committed to upholding this position in all judicial authorities.
The TSJPV ruling is not final, so the Planning Decree remains in force, and while the legal proceedings are resolved, the Ministry of Education will move forward in developing the regulations resulting from the Education Act. One of the priorities is to draw up a new text that includes the progress in educational planning provided for in the regulations.
