Due to the unclear clause – tenants no longer have to pay the operating costs

Date:

In the future, a Salzburg couple no longer has to pay the landlord for channel, water and heating – they even get the operating costs that are paid so far. The Supreme Court has decided a legal dispute. The reason is a “non -transparent” clause. The lawyer “Krone” explains the details.

For decades, the tenants, a Salzburg couple and the landlord, were the director of a company, friends. Together the two parties signed a lease in July 2020, in which a lease contract for an apartment in the city of Salzburg was established at the beginning of January 2021. Rent: 1285 euros plus sales tax and 180 euros operating costs.
