Notebook not used for long
In various media reports, the handling of the DSN was criticized with electronic evidence. The focus was on a notebook by Hasan E., which is located in Austria. According to DSN, however, there were several testimonials that this notebook had long been used. The responsible public prosecutor therefore abandoned a security warrant – which meant that the DSN could not seize it.

No access to Hasan E.
At the same time, the suspect’s mobile phone was already in the hands of Saudi security authorities. Austria had no access to the device or the stored data. Messenger courses could not be viewed due to legal limitations.

The DSN is therefore forced to defend itself in a statement – a rare procedure for an authority that normally acts in hidden. The reason: Apparently there are targeted attempts to incorrectly present the research work, which can harm the credibility of protecting the constitution. In particular, the presentation of which researchers deliberately rejects with important data contradicts the actual processes.

No proof of radicalization
The fact is that the investigation after information about the lower Austrian, Hasan E. arrested in Saudi Arabia immediately asked. 21 Witnesses, including family members, were interviewed. Because no evidence of radicalization is available, no further measures were ordered. “Without this regulation, the criminal police were legally prohibited from determining further – independent – investigation measures,” the DSN said.

It was only after more than 41 mobile phones that the planned attack on the concert in Vienna, Beran A., was a direct reference to Hasan E .. In the end this also led to the subsequent security of a notebook – but there were no communication data.
