First the owner of the Kebabhat beat a man with a wooden sword, then he stabbed him. An attempted murder, the jury ruled Friday at the end of the trial in the Salzburg regional court.
First, the suspect – a Turkish kebab owner and married family man – is said to have sprayed a compatriot with pepper spray on 12 May 2021 in a parking lot in Bürmoos and beat him with a 64 centimeters long wooden sword. He is said to have tried several times to push the victim’s eyes inward.
The same day, hours later, the next brutal incident followed: this time in the stairwell of the suspect. A fight in which the 41-year-old allegedly stabbed him with a knife. The prosecutor spoke of a life-threatening injury. From a stitch that went through the t-shirt, shirt, sweater and down jacket to the area of the heart. The “Krone” turned himself in on the first day of the trial.
Accused denied with knife
But the defendant denied ever having a knife. Lawyer Bernhard Kettl spoke of contradictions: on the one hand, because of the victim’s behavior after the crime. On the other hand, there should have been an argument with a family clan in the background. Even the previously impeccable suspect said at the beginning of the trial, “I’m afraid of the family clan.” He saw himself as a victim.
Close jury decision
In the end, the jury followed the prosecution: a narrow “yes” to the charge of attempted murder by five to three, and also a “yes” to the charge of attempted aggravated assault. Punishment: The Turk now has to serve 11 years in prison. Neither the defense nor the prosecution has issued a statement on the appeal. So three days to think about it. The verdict is not final.
