Why a young man in Carinthia had to die is also unclear after the process. One thing is certain that he was in the wrong place at the wrong time when a shot loosened from a gun. In the case of murder, it was initially determined – there is a conviction to be partly due to coarse negligent murder.
It is a hot summer night in Knappenberg. And also heated. A 44-year-old device in the restaurant with his stepson in a fight, drives home. But the young man calls. “He probably threatened him to kill,” says Public Prosecutor Veronika Holub.
Wild drunk people
And accompanied by friends comes to the remote house of the stepfather. “This was scared, took the gun out of the bedroom cabinet and wanted to chase the drunken away.” The accused nods. That is exactly how it was – he wanted to intimidate, but nobody did anything. The victim, a young entrepreneur with whom he would have had nothing, was also besides the stepson, had grown: “Shoot, you Kaperl!”
Shot in the middle of the heart
And the shot has come loose. Hit the 36-year-old in the middle of the heart. First of all it was determined for murder, after which the talent reconstruction demonstrated that the killed had also reached the gun. “The low trigger weight is striking with the sports weapon from the 1950s,” said expert Manuel. If the finger is on the trigger, a small load is sufficient and it turns off.
“Nevertheless, it is incomprehensible to the victim’s family that it should not be a murder,” says private participants. For the accused and defender Philipp Tschernitz, however, roughly negligent killing is the correct legal classification. “I’m very sorry,” the Death Shooter claims several times.
The verdict takes the invoice: 15 months in prison, ten of them, plus mourning pain money between 5,000 and 10,000 euros for the individual survivors of the victim. The decision is not yet final.
