A driver of Leondingen defends himself against “fine payment” and fights before the court. The reason: for a short stop at a private parking space, he has to pay more than 300 euros. Experts see the government challenging and want a change in the law.
Hundreds, if no more than a thousand provisional exemption with the requirement of more than 300 euros, sent a lawyer on behalf of his client. Recipients were drivers who had a home on the Linz trade union, where a popular sausage standard was found until a year ago.
Each case must be checked separately
This is a bad rise for most affected people, but they still pay. The Leondinger Real estate loan Robert Gassner defends itself (we have reported). He lets it down on a hearing: “I see no possession of the possession because I immediately went on when I recognized my mistake,” he says.
And this is exactly where the problem is buried. “Every case must be checked individually because nobody is the same. And that makes it so difficult,” says Ulrike Weiß, consumer protector of the upper Austria of the Chamber of Labor (AK). There were also numerous questions and complaints in this context.
Corinna Hotz of the Legal Service of the ÖAMTC sees it in the same way: “Unfortunately, it is legally difficult. We also explain this to our members, and the passage before the court is risky because there can be even higher costs if you can lose the process.”
When is there a disruption?
The two experts therefore urgently urgently ask for a change in the law, which especially clearly regulates when a “condition” really has. That is why it would be important that there are people like Robert Gassner who let it wait, wait for a court decision and then go through all cases. “I represent myself in the first procedure. If I lose, I will call the judgment and then hire a lawyer. I am sure I am right,” says the Leondinger Combative.
