Officers complained – mandatory vaccination for German soldiers confirmed

Date:

The corona vaccination obligation for German soldiers remains in force. This was decided by the 1st Senate for military service of the Federal Administrative Court in Leipzig on Thursday. He rejected the complaints of two Air Force officers against including the corona vaccination in the so-called obligation to tolerate. The lieutenant colonels saw their fundamental right to bodily integrity violated. The decision is final.

The situation assessment of the German Ministry of Defense at the time of the decree in November 2021 on the obligation to have a corona vaccination was correct, the Senate President Richard Häußler emphasized. Soldiers often perform their task together in confined spaces, tanks, aircraft or ships, which poses a particular risk of spreading communicable diseases. “The coronavirus is what used to be called an epidemic.” It was therefore justified to include it on the list of vaccinations.

Judgment does not apply to booster vaccination
However, the court obliged the ministry to reassess the situation before ordering a booster vaccination. “The reduction in the danger of the SARS-CoV-2 virus and the reduction in the effectiveness of the currently available vaccines are circumstances that make a renewed discretionary decision to order further booster vaccinations appropriate,” it said.

Due to the peculiarities of the Military Complaints Act, the decision initially only applies to the two lieutenant colonels. According to the Senate of the Military Service, the German Federal Administrative Court still has several complaints from soldiers from different areas.

German soldiers must be vaccinated against a range of diseases if there are no specific health reasons for not doing so. These include hepatitis, measles, rubella, mumps, and the flu. On November 24, 2021, the German Ministry of Defense included a Covid-19 vaccination as mandatory in the general scheme for the central timetable “Vaccination and other prophylactic measures”. Since then, a so-called obligation to tolerate this has been in effect. vaccination. Anyone who opposes the vaccination schedule should expect disciplinary action.

In Austria, soldiers must be vaccinated when deployed abroad.
