After murder in Tyrol – killed acquaintances: OLG confirms “Lifelong”

Date:

The judgment against a Poland (31) – He was sentenced to life imprisonment in October by the Constitutional Court of Innsbruck for the crime of the murder – was confirmed on Wednesday by the Higher Regional Court (OLG). The man had killed a 36-year-old Tyrolean knowledge in his apartment in Itter (Kitzbühel District) with a knife.

The judgment is therefore final. The lawyer of the Poland had submitted in October after the conviction of the first instance and an appeal against the punishment and the private law claims of the Berouved. The Supreme Court (OGH) has already rejected the annual complaint in February of this year. For example, the Senate of the Senate of the Innsbruck decided higher regional court in the first place in the first place on Wednesday – and eventually left it as before.

No reasons to reduce the punishment
In the reasoning it was made clear that there were no previously ignored reasons to reduce the punishment. “For example, there can be no renowned confession,” the judge said. Moreover, there were four relevant criminal registers and the crime had been committed with a weapon in the victim’s apartment, he explained serious reasons for difficulties, making a life sentence “guilt and action”.

The private parties with the relatives also kept upright: the man has to pay around 14,500 euros. The accommodation in a forensic-therapeutic center that was pronounced at the time.

Defenders threw everything in the balance
Earlier the defender of the Polish citizen had thrown everything in the hearing of half. The lawyer saw the penalty height as “clearly too high” because some “relevant reasons for mitigation” were not sufficiently taken into account in the jury process at that time. “He was direct and was also limited,” said the defense lawyer. In any case, his client was “psychotic” at the time and moreover “a very different than today.”

The main prosecutor, on the other hand, did not follow the lawyer’s assessments. “There are no reasons for mitigation that would initially not have been taken into account a reduction in the level of fine,” she argued. The confession was “neither renowned nor extended”, nor the man’s statements “who significantly contributed to the finding of the truth,” said the main prosecutor. On the other hand, the action made things worse that she had happened to the victim’s apartment. “For all these reasons, a reduction is not possible,” the main prosecutor emphasized.

Suspect: “I wasn’t that then”
In his last words before the announcement of the judgment, the 31-year-old again claimed that he was “very regret”. “I wasn’t that then,” he said. He was not only “mentally affected”, but was also massive under the influence of alcohol and drugs. He had “nevertheless self -confident”, although he “there is no memory of the crime at all”. “But I still committed crime,” he explained in the same way as the negotiations in October. “In any case, I ask them to mitigate the sentence,” he concluded before the senate withdrew from the judge for advice.

In October 2023 there was a violent dispute between the influence of drugs and alcohol between the two men in October 2023. The 31-year-old took a knife in the kitchen block and stabbed the 36-year-old. The next day the knowledge was bloodless by his mother and was already found dead in the apartment. The pole was then arrested three days after the crime.

The 36-year-old “provoked” him on this day, the 31-year-old had carried out during the negotiations in October last year. “He showed me drastic videos from the Second World War, in which you can see what the Germans did with the Poles,” said the Polish citizen. Drugs and alcohol were “consumed together”. After that his memory was just radically demolished: “I only saw that he was dead in the morning.”
