Recently there was a judgment of the Supreme Court that women are only biological women in the sense of the British law on equal opportunities. As a result, Transvrouwen cannot rely on the same rights. Now there are even more difficult restrictions on how a provisional directive of the British Commission for Equality and Human Rights (EHRC) will come to the fore.
The judgment, among other things, had an influence on workplaces and places where accessible services are offered for the public, such as hospitals, shops, restaurants, leisure facilities, refuge and advisory centers, as well as sports facilities, schools and clubs, the directive said.
According to the directive, workplaces must separate individual toilets according to gender and as far as they are needed- also washing and changing rooms. This is not absolutely necessary for the places that are accessible to the public. However, it can be discriminatory for women if there are only mixed facilities.
Cabinet member: no toilet police
In certain circumstances, it is also legally permitted that transvrouws are excluded from facilities for men and channels of those for women. However, there should be no situation in which transgender people no longer have an option. If possible,, in addition to sex facilities, that must also be made for common use.
