Against Discrimination – Slovenia: Adoption Rights for Homosexuals

The Slovenian constitutional court has opened up same-sex marriage on Friday and now also grants homosexual couples a joint adoption right. Previous regulations, allowing only heterosexual couples to marry and adopt children together, were declared unconstitutional.

With immediate effect, same-sex couples were given these two rights. According to the Constitutional Court, the previous arrangement was contrary to the prohibition of discrimination. Opening up marriage to homosexuals in no way diminishes the importance of traditional marriage. “It simply means that in addition to different-sex couples, same-sex couples can now also marry,” according to the Constitutional Court.

The decision just made public was taken in mid-June when the Supreme Court heard constitutional complaints from two gay couples. At the time, their marriage and fair adoption opportunities were denied.

“Exclusion is against the purpose of the child’s welfare”
Until now, only stepchild adoption was possible for homosexual couples in Slovenia. Now, however, same-sex partners should be given the same opportunities as married couples to adopt children. The general exclusion of same-sex partners reduces the number of possible adoptive parents, which, according to the court, is contrary to the best interests of the child.

Since 2016, homosexual registered partnerships in Slovenia have almost the same legal status as marriage. However, the right to adoption and the right to artificial insemination have so far been prohibited to them.
