The cemetery of the crime scene: Last July, two gardeners fought a violent examination of garden scissors and kicks between Graves in Vienna-Ottakring. Why the two arguments have fallen together cannot be clarified in the Landl process – both speak of self -defense. The lay judges are not convinced …
It is actually a place of calmness and peace – the cemetery of Ottakringer. However, this was disturbed exactly a year ago, on July 10, 2024, of all people from two Viennese gardeners who had a bloody argument between Graves. With garden scissors, kicks and iron rod. “At the end of the day, injuries came out,” summarizes the Salopp public prosecutor.
Colleagues share docks
The two arguments now share the dock in the Vienna Landl and do not honor themselves while they are maximum far apart. Both men tried to accuse serious attack. Both the 42-year-old and the 47-year-old see themselves in a self-defense situation. As so often, the versions could no longer be different.
“I hit him with a pole”
The younger cemetery gardener explains the Schöffensenat: “I told him that I would go on holiday with a woman.” Then his colleague was panicked and would have reached the damage-the 42-year-old defended himself only with the 50 cm railway. “I never took the garden scissors in my hand,” he says, but admits: “I once hit him on his head with the pole.”
Again, the version of the 47-year-old was completely different: the first time sued him for a long time had terrorized him with abusive words and provocations. “My client did what he had to do,” says defender Michael Babic that the man and her supervisor reported to his colleague.
Defended with damage?
This in turn did not fit. “He reaches the bet and takes a garden scissors,” says Babic. “My client was afraid of his life. He had no other option than grabbing and determining defense actions.” And the gardener did that with a kick.
However, the Schöffensenat does not believe that one of the gardens it determines convicts for both: the 47-year-old collects a year due to serious physical injury. The 42-year-old on trial for four months for “simple” physical damage.
