Life imprisonment – Detective calls for lighter sentence

Date:

Life imprisonment and incarceration in an institution: this is the non-final sentence for Gottfried O. after the double murder of two women. The private investigator is appealing.

On Thursday, the jury unanimously found the Salzburg private detective (52) guilty of double murder. On May 5, 2021, Gottfried O. murdered his ex-girlfriend Helga B. (50) and her mother (76) in their home in Wals with eleven shots from a Glock pistol. He confessed this. The motive was apparently anger at the woman’s rejection. For this, it imposed the highest penalty known in the criminal code: life imprisonment including admission to an institution for mentally abnormal lawbreakers.

nullity appeal and criminal appeal
This verdict is not yet final, as both the suspect and the public prosecutor can challenge the decision. Defense attorney Andreas Schweitzer has now confirmed to the “Krone” that both a nullity complaint and a criminal appeal will be filed. Means: O. wants a more lenient sentence. Also means: The legal settlement of the bloody act is moving into the next round.

The Supreme Court is next in line. The Supreme Court must investigate whether there are legal errors. Should this be the case, the verdict must be quashed and the trial repeated.

If the invalidity appeal is rejected, the conviction becomes final. The Higher Regional Court of Linz must then decide whether the amount of the fine is justified. It is unclear whether the Public Prosecution Service will also take legal action – the sentence cannot actually be higher. The deadline for this is Monday 11:59 PM.
