A 21-year-old allegedly raped a girl in a Viennese park in March this year. He says it was different. The court agrees and acquits him.
It should have been a boisterous party night. The money ran out and she called a friend to ask her to lend her something. She met him in front of the nightclub, got into the car he came in to warm up and smoke a cigarette. The driver would have simply accelerated – he is now in court as a defendant. The other passengers got off at their destination. The 21-year-old Syrian and the girl were now alone in the car.
Accused silent in court
Time and again she would have asked him to drive back to the club. He allegedly forced her to get out of the car in a park. He allegedly raped her on a couch. Then he brought her back. He declined to comment in court.
Acquittal for 21-year-old
Lawyer Philipp Wolm is sure that his client is innocent: “Especially in the case of sexual offences, the victim’s statement is often the only evidence.” Otherwise there would be none and the Public Prosecution Service also has many contradictions. She is said to have borrowed money from him after the incident. The different witnesses also tell the incident differently than the girl. “If one believed the statement of the alleged victim, the inverse conclusion would be that all witnesses are lying,” said Wolm – acquittal!
