The ruling of the European Court of Justice on the VW diesel scandal in mid-July made Upper Austria optimistic. The ECJ found that the fraudulent software had almost certainly not been improved.
The VW driver from Enns owns a Golf with a scandalous engine and had sued VW. But now he received a letter from his legal aid insurer offering him 1,000 euros if he withdraws the lawsuit. His Linz lawyer Michael Poduschka: “The insurance company states that it can be assumed that the procedure will be rejected. She argues with expert opinion about a completely different engine type.” After several years of waiting, the car owner concerned feels that the letter is the “next left”.

Poduschka, who expects the process to end on a positive note: “It annoys me that the insurer intervenes in a process and confuses customers. Your legal opinion is not only incorrect, but was represented by an unauthorized person, a clerk.
