According to local dishes, a share of only ten percent yogurt in ‘frozen yogurt’ is far too little: the Salzburg Regional Court had already ruled the product of the Spar retail chain as misleading. The High Court of Linz has now confirmed the verdict and is legally binding, the Consumer Information Association (VKI) announced on Tuesday.
The VKI had filed a lawsuit on behalf of the Ministry of Social Affairs for misleading product presentation of “Spar Frozen Yogurt”.
The yogurt content should be 60 percent
Spar sells frozen milk yoghurt products under this name. On the front of the label there is a white mass that looks like yogurt. For all variants the share is only ten percent, while products from other manufacturers have a much higher yogurt content according to VKI. The “Austrian Food Act” stipulates that 60 percent of the milk components in the product must be yogurt.
Spar’s appeal against the attack in Salzburg failed. The Oberlandesgericht Linz agreed with the legal opinion of the Landsgericht Salzburg. It emphasized that compliance with legal labeling requirements generally does not protect against deception. Spar had argued with the ingredients list, which clearly showed the yogurt content, consumer advocates reported.
