How long can it take the government of Spain to pass the Judicial Reform Law?

Date:

There is a lot of speculation about the possible dates. One month… three months… EiTB Media has put the question to several lawyers and also to ETB’s Congressional correspondent, Amaia Etxezarreta.

The government of Spain has activated its plan B and announced that the law of Proxy and the Constitutional after quitting the guarantee court will issue its approval through the amendment of the Penal Code as a bill. This new position could be reported this week. The question that remains, however, is… When would it be approved?

In the last few hours there has been a lot of speculation about the possible dates, and it is that the possibilities are many. If the formula they apply is urgent, many think it could be ready for that late January or early February.

It should be borne in mind that January is a non-working month in Congress. However, while the rules of Congress itself guarantee that the plenary session of the chamber will not meet once in the first month of each year, it would not be the first time that plenary sessions have been held.

Several lawyers for their part have told EITB Media that this could take at least three months. we would already be inside March.

However, and according to the ETB correspondent in Congress, Amaia EtxezarretaThis is a difficult question to answer, as there are several factors that determine this, such as the political will or the routine steps to be taken in this type of procedure.

The Congressional correspondent points out, however, that a decision must first be made on exactly which formula they will present, and at what time, so the exact date cannot be known. While not done as “urgent,” procedures can move quickly, as “the rhythms are dictated by the table,” he points out. “If you have a solid majority, that has been agreed in advance,” he emphasizes.

Etxezarreta believes that, after what happened, urgency is not a priority for members of Congress, but the safety that it is worded correctly so that no steps are taken backwards, “and the escape route has that risk”, he stressed.

In other words, the idea is that “no loose ends are left, so that neither the Constitutional Court nor the European Court are at the top. Therefore, they must look for the safest possible formula,” he adds.

At the moment, all political groups already have the PSOE bill in their hands and it is visible that the investiture bloc is united, at least in this.

In fact, today the ERC spokesman in Congress, Gabriel Ruffianhas offered its support to Pedro Sánchez to implement the bill that aims to renew the Constitutional Court despite the body’s refusal to approve it through amendments to the Penal Code.

What they have clarified is that the initiative will not correspond with the government of Sánchez, but with the parliamentary factions of the investiture bloc. This initiative is intended to reflect the spirit of the two amendments suspended by the Constitutional Court for its own renewal.
