In the case involving the head of the Vienna Public Prosecutor’s Office, Johann Fuchs, the Innsbruck Higher Regional Court overturned the guilty verdicts of the Innsbruck Regional Court in August. Fuchs was sentenced to an unconditional fine of 72,000 euros for violating professional secrecy and making false statements to the Ibiza commission of inquiry.
The criminal case must now be renegotiated and decided at the Innsbruck court, it said. Fuchs had appealed the verdict. The Higher Regional Court justified the current decision in a broadcast by the reasoning and finding deficiencies in the statement whether there was a need to testify.
In December 2020, the renowned lawyer allegedly passed parts of a complaint against a “Presse” editor to suspended section head Christian Pilnacek. The Public Prosecutor’s Office for Economic Affairs and Corruption (WKStA) had prepared a complaint against the journalist (who was ultimately not prosecuted due to a lack of initial suspicion) based on an article she had written critical of the authority. Fuchs had denied the disclosure at trial.
