Now the four new magistrates must swear or pledge their positions before King Felipe VI, expected on Saturday morning, and will take office on January 9.
The plenary session of the Constitutional Court has this Thursday unanimously approved the adequacy of its four new magistratesproposed by the Government of Spain and by the General Council of the Judiciary (CGPJ), which is the final step for its extension, which will lead to a court of guarantees with a progressive majority.
As reported by the TC, its eleven magistrates, meeting this Thursday in an extraordinary plenary session, confirmed that the four candidates meet the requirements of the Constitution.
Once full assent has been obtained, the four new magistrates will have to swear or pledge their position before King Felipe VI before taking office, and then debate will open over who will become the new president of the Constitutional Court, a position to which the progressives aspire. For now, it is expected that the four new magistrates will be sworn in or pledge their duties before the king on the morning of December 31 and take office on January 9. A day later, the plenary session is expected to take place in which it will be elected who will hold the presidency of the court.
This was the last procedure to get one extension pending June and was detained for these months due to the inability of the members of the CGPJ to agree on the designation of the two magistrates who corresponded with them. Agreement finally reached this Tuesday after the progressives gave up their votes and ended with the election of the conservative César Tolosa and the progressive María Luisa Segoviano.
This translates into a change in the balance of power of the court, which will have seven progressive magistrates and four conservatives, with a vacancy still open, which corresponds to the Senate.
