The European Court of Human Rights to deliberate this Monday on the appeal in the case of the prisoner Atristain

Atristain denounced being denied access to a lawyer while being held in protective custody incommunicado. The ECtHR ruling confirmed his appeal and ordered Spain to pay him 20,000 euros. The prosecutor has lodged an appeal, which will be analyzed tomorrow.

The European Court of Human Rights (ECtHR) will decide on Monday at the request of the Spanish government in the case of ETA prisoner Xabier Atristain on the prosecutor’s appeal against the judgment in Strasbourg that condemned Spain. for violation of the right to a fair trial to this member of ETA.

A panel of five ECHR judges will decide whether or not to refer seven judgments to the Grand Chamber of the European Court, including Atristain, which was appealed by Spain on April 13, through the state attorneyas submitted to the Supreme Court by the Department of Justice.

If the government’s request is granted, the Grand Chamber — composed of 17 judges — will investigate the case and issue a final judgment, as indicated by legal sources. In the event that it is not complied with, the judgment of the Chamber — dictated on January 18 — will be final.

The ECtHR decision upheld Atristain’s appeal and condemned Spain to compensate him with an amount of 12,000 euros for non-material damage suffered and 8,000 for costs and expenses.

Atristain went to Strasbourg to denounce it while incommunicado in protective custody, he was denied access to a lawyer of his choice and was questioned by the police without the presence of a lawyer, leading him to make self-incriminating statements, which he said led to a 17-year prison term.
