Due to a loophole in the law, the court was unable to issue a professional ban against ex-Burgstar Florian Teichtmeister. According to Justice Minister Alma Zadić, the paragraph is now being patched.
Ex-castle actor Florian Teichtmeister, who was sentenced to two years on probation on Tuesday, will be closely watched by the instructions Judge Stefan Apostol issued when the verdict was handed down – he agreed to regular psychotherapy, strict abstinence from alcohol and drugs and a probationary period.
inaccuracies in the legal text
The verdict reveals a lack of clarity in sexual criminal law. Because the court could not establish something: Florian Teichtmeister, who was described by the public prosecutor as “pedosadistic”, is even allowed to continue working with children. Al, the former TV star photographed a child actress on set, accompanying the image with disturbing violent fantasies.
The conditions for a professional ban have not been met
“In the present case, the requirements for a professional ban are not met, as appears from the text of the law,” confirms court spokeswoman Christina Salzborn. Article 220b of the Penal Code stipulates in abbreviated form that a suspect should have been involved in the upbringing or supervision of minors at the time of the crime – which Teichtmeister has not done. A loophole that once again leads to dissension within the federal government.
Federal Minister Susanne Raab and State Secretary Claudia Plakolm (ÖVP) criticize Alma Zadić (Greens): “The Minister of Justice must finally implement stricter sentences. That is insane,” says Plakolm. Zadić replies: “The revised design will be decided after the summer holidays. Penalties are sometimes doubled or even tripled. In addition, the activity bans for convicted offenders will be extended, so that they will no longer be allowed to work with children and young people in the future.”
‘He definitely doesn’t want that’
For Teichtmeister, the amendment changes nothing. His lawyer Rudolf Mayer reassured: “He should work with children, but he absolutely does not want to.”
