It will be the final step towards a reform that will replace the term ‘disabled’ with ‘person with disabilities’ in Article 49 of the Spanish Constitution.
The Senate plenary will debate today the constitutional reform that will allow the term to be replaced “disabled” for “disabled” in article 49 of the Magna Carta. Last week, Congress approved the reform proposal with 312 votes in favor to 32 against that of Vox, which abstained.
Yesterday, the Constitutional Commission also debated the proposal, and Santiago Abascal’s party (which is part of the Mixed Group) did not participate in the meeting.
This constitutional reform was promoted by the Committee of Representatives of People with Disabilities (CERMI) in 2018 and, together with the support of the then vice-president of the government, the socialist Carmen Calvo, he reached Congress with a unanimous agreement to replace the article with a new text “more in line with the new times”.
Currently, Article 49 of the Constitution is worded as follows: “The public authorities shall pursue a policy of provision, treatment, rehabilitation and integration of physically, sensory and mentally handicapped persons, to whom they shall provide the specialized attention they need and to whom they shall to protect. them above all for the enjoyment of the rights which this title confers on all citizens.”
So, plans to change the wording to “enable persons with disabilities to exercise the rights provided for in this title, under conditions of real and effective freedom and equality.” “The special protection required for this exercise will be provided for by law,” it added.
Moreover, the second point will read: “Public authorities will promote policies that guarantee the full personal autonomy and social inclusion of people with disabilities, in universally accessible environments. Likewise, they will encourage the participation of their organizations, in the conditions established by law. Particular attention will be paid to the specific needs of women and minors with disabilities.”
The Senate Council, like Congress, decided yesterday not to allow amendments to the constitutional reform of Article 49. because you don’t have a ‘direct relationship’ with the regulated matter.
