They have rejected the ‘popular’ arguments, realizing that in this case there is no question of administrative fraud or illegal appointment.
The Supreme Court (TS) has agreed to dismiss for hearing the complaint filed by the PP against the State Attorney General, Álvaro García Ortiz, because it has seen no evidence of a crime involving his predecessor, Dolores Delgado, as chamber prosecutor has proposed to the Public Prosecution Service of Togada of the Supreme Court.
The magistrates rejected the ‘popular’ arguments, realizing that in this case there was no administrative fraud or, secondly, illegal appointment.
The group led by Alberto Núñez Feijóo defended that García Ortiz’s actions were “susceptible to be classified” as a crime of deception, because he acted “arbitrarily”. He assured that the Attorney General had formulated his proposal “knowing that Dolores Delgado was not the ideal candidate to fill the vacancy.” According to the ‘popular’, García Ortiz proposed her “randomly and despite not being the best positioned candidate.”
This Monday, the Supreme Court concluded that “the complaint filed does not reveal any indication of criminality that justifies the opening of criminal proceedings.”
