The European judicial system has rejected the appeal brought by Puigdemont and Comín against the President of the European Parliament (Tajani) for not recognising their seats at the start of the previous parliamentary term, in July 2019.
The Court of Justice of the European Union (CJEU) on Thursday agreed with the European Parliament in denying entry to Carles Puigdemont and Toni Comín because the Central Electoral Council had not published their names for failing to comply with the Spanish Constitution in July 2014.
“The President of the European Parliament could not deviate from the list of elected representatives officially communicated to him by the Spanish authorities,” the CJEU ruling said, referring to Antonio Tajani, who was President of the European Parliament at the time.
According to the ruling, “the President of Parliament has no power to verify the accuracy of the said list”, and therefore Tajani limited himself “to what he was obliged to do: take note of the list of elected deputies communicated by the government to the Spanish authorities”.
So the highest judicial body of European justice has rejected the appeal filed by Puigdemont and Comín against Tajani because they had not recognised their seats at the beginning of the previous parliamentary term, in July 2019.
