After just five minutes, the second day of the trial against ex-BVT chief inspector Egisto Ott and ex-FPÖ politician Hans-Jörg Jenewein is over. The reason for this, if justified, is to embarrass the judiciary. According to Jenewein’s lawyer, the Public Prosecution Service forgot to waive the immunity.
Jenewein worked as a national councilor for the FPÖ until the end of 2018 and was also active as committee chairman. It was during this time that the accused acts took place which landed him in the Vienna dock together with Egisto Ott, who was suspected of espionage. According to the Public Prosecution Service, Jenewein allegedly forwarded images from the BVT and the Ibiza Commission to Chief Inspector Ott and a journalist.
Delivery expires
The second day of the trial, which concerns violations of official secrecy and violations of data protection regulations, starts with a petition from Jenewein’s lawyer Christoph Rother. “My client was a national councilor at the time and enjoyed immunity. “The Public Prosecution Service has never formulated an extradition request,” he explains, adding that the proceedings against Jenewein were unlawful and should therefore be stopped. Especially now that the possibility of extradition has already passed two weeks.
Trial suspended indefinitely
Judge Andreas Böhm is surprised: “I assume that the criminal case has gone through all the authorities and that this has been investigated.” Anyway, Egisto Ott’s lawyers immediately jumped on the bandwagon. Josef Phillip Bischof is convinced that if the procedure against Jenewein is unlawful, it should also be stopped against Ott. The lawyers leave the Grand Jury Courtroom in Landl, Vienna, with big grins on their faces.
