The office of the Economic and Corruption Officer of Justice (WKSTA) hired the research into office abuse around the former head of Section Christian Pilnacek. The question was whether two officials around the body’s discovery were relevant under criminal law.
After extensive investigations, the WKSTA arrived until the end of stopping the procedure. She sent a corresponding report to the responsible higher authority. This already came to the same result in its instruction, “although in the way of a different assessment of the facts and the resulting legal justification”. In any case, the opinion of the parties was “unanimous,” said the Upper Procedor’s Office.
Display of Kreutner, Doubts of Pilz
The investigation was preceded by a report by Martin Kreutner, the head of the investigation committee, which had dealt with a political influence in the Pilnacek term of office as head of the section. The presentation of the fact was not about the circumstances of the death of Pilnacek, but about the acceptance of personal objects after the discovery of the body by criminal officers in his house.
Pilnacek’s body was found on October 20, 2023 near Krems. The public prosecutor of Krems has excluded the fault of the third party on the basis of an expert opinion. The former member of the National Council Peter Pilz, however, expressed doubts and substantiated this with two forensic medical reports based on the autopsy report. As a result, the office of the Vienna main prosecutor ordered the investigation into the death of the former head of the section in the Ministry of Justice.
