Now it seems solved: Messenger monitoring is more effective. In the future it must be able to focus on danger. In the Ministry of the Interior people speak of a “milestone”.
Now ÖVP, Spö and Neos will probably have been agreed. In the future, the police will have easier access to private mobile phone data, as the “Kroon” has learned. “About three months ago, after a council of ministers, I said that the protection of the constitution of terrorism and extremism had to fight at eye level. Three months later we already met this important point of the government agreement and thus established a milestone in the terrorist defense,” said the Minister of the Interior Gerhard Karner.
What will be possible now
More details will be presented to the Council of Ministers on Wednesday morning (from 8.25 am). But some things have already been clear: Messenger monitoring of potential indangers should only be possible under certain circumstances. The criminal police must have a reasonable suspicion of a possible terrorist attack and the surveillance must be ordered by a Senate with three judges.
Each measure must be continuously checked by a legal protection officer and is limited. In particular, the NEOs recently urged further improvements when it comes to legal protection, abuse prevention and control over the software.
Karner: “Go away”
The focus would be on terrorism and the intended procedure against “constitutional persons”, according to the Ministry of the Interior. If there are more than 30 applications per year, a special report must be made in the responsible Investigation Committee. The hazard monitoring should only take place if it is absolutely necessary for investigations and if it is legally possible.
The legal basis for monitoring potential indangers must be decided in the plenum before the summer. The use of the measure is planned for January 1, 2027. When the law is completed, the technical means for this are purchased – including international experts. “There is still a lot of hard work ahead, but we will consistently come to an end,” Marker emphasized.
Criticism
“In addition to the Spö, the Neos have now fallen over,” said digitization spokesperson Süleyman Zorba in a broadcast on Tuesday. Despite “cosmetic corrections”, the basic problem remains, he said. “The use of state py software – as well as Bundrojan – is and remains a dangerous respiratory fracture. The potential for abuse is enormous, the technical implementation is uncertain and the constitutional concerns are far from freedom.”
