Supreme Court reduces prison sentences for convicts of ‘Osasuna case’

The Supreme Court has reduced the prison sentences imposed on the nine convicts in the so-called ‘Osasuna case’, in which it was found proven that members of the Navarra club’s board of directors agreed to give priority to former Betis players Antonio Amaya and Xavi Torres for “changing the results of sports competitions”. It imposed sentences ranging from ten months to five years and seven months in prison.

In a verdict, which Europa Press has had access to, the magistrates partially upheld the defense’s appeal for acquittal. The court has agreed to uphold the sentences for the aggravated crime of embezzlement imposed by the Supreme Court of Navarre, although the sentences corresponding to those for the crime of forgery are slightly reduced, by establishing that those convicted of this crime can only be punished for one crime and not two in competition as the Court appreciated – and for sporting corruption, as well as the associated fines.

The Supreme Court’s decision comes after the Public Prosecution Service last November asked the court to uphold the verdicts as it was proven that members of the club’s board of directors agreed to give priority to two Betis players to “take the results of sports competition”.

At the public hearing, presided over by magistrate Julián Sánchez Melgar, the defense spoke out against the verdict, which imposed sentences ranging from eight years to eight months in prison and one year in prison for crimes of embezzlement, lies in commercial documents, false accounting and sports corruption. Osasuna and LaLiga’s allegations coincided with the prosecution’s criteria and asked the Supreme Court to uphold the verdicts.
