“If you have an accident and someone is on the ground, why do you just drive away?”, Judge Manfred Hohenecker of the court of Korneuburg wondered. And rightly so: because that’s exactly what the accused 55-year-old did after hitting his partner. As she lay dying on the ground, he drove on to the nearest pub. “The nighttime behavior is anything but commendable,” the judge recalled.

The day before the last lockdown started, the couple partied and drank in the equestrian center. “Then it all takes an unfortunate course,” explains defender Farid Rifaat. The two drove home drunk. They wanted to get something to drink at a nearby gas station. Then the accident happened: the woman got out, the suspect drove off and hit the 49-year-old with his Dodge Ram.
“Short action” after act
“I got out and wanted to lift her into the car. Then she stopped moving,” says the Viennese calmly. “And then you went drinking a few feet away while your wife died?” Judge Hohenecker asked, startled. This would have been a “short-cut act”.
Not murder, just negligent homicide
The 55-year-old was also heavily intoxicated — according to the report, he probably had 1.98 per thousand. “Yet a woman has died and that is the fault of the suspect,” the public prosecutor recalls. While the suspect was initially suspected of murder, he is now charged with death by gross negligence. Intent to injure or kill could not be proven.
15 months partially conditional
Nevertheless, Judge Manfred Hohenecker rules: “The negligence is so gross!”, and sentences the Viennese to 15 months, including five months suspended prison! “You have to feel that this mistake also has an impact on your life,” he explains.
