Case Lukas – Upper Austria: Hospital doctor and midwife in the crosshairs of the judiciary

A baby named Lukas died after birth, the public prosecutor in Wels is investigating culpable homicide. But now against a doctor and two midwives.

A completely failed birth led not only to the death of a child, but also to investigations of several hospital employees of the Vöcklabruck clinic for wrongful death. The “Krone” reported several times about the fate of Lukas, who was born in December 2021 after a uterine rupture with severe brain damage and died a few days later. As is known, the public prosecutor’s office in Wels has investigated two doctors and a midwife.

But now there is a new development, as the prosecution of the “Krone” confirmed: “In this case, we are investigating a doctor and two midwives,” says spokeswoman Silke Enzenmüller. One of the two accused doctors had filed a request with the Wels Regional Court to stop the investigation. With success: the court followed the doctor’s request, because according to Enzenmüller there was “no breach of care” on his part.

In his application, the doctor referred to the police report of Christoph Brezinka, who found a “sum of care violations” that led to a “uterine rupture” at birth. This was subsequently “the cause of Luke’s death”. Victim lawyer Stefan Rieder, who represents Lukas’s parents, can understand the decision of the judiciary: “The doctor happened to be there alone during the birth process and only provided assistance.” The allegations relate more to the senior doctor responsible at the time.

What is new is that a second obstetrician is now listed as a suspect. The investigations are therefore likely to take longer – a decision is unlikely to be made this year.
