In the case of the defective contraceptive coil “Eurogine” from a Spanish manufacturer, there is a first judgment – but a large number of undeclared women in Austria! 28,502 of these spirals were used, but “only” 1000 women reported.
The consumer protection association VSV is certain that up to 19,000 women have been “abandoned by all parties in Austria”. The designated VSV president Daniela Holzinger-Vogtenhuber – she takes over from Peter Kolba – denounces the responsible Federal Office for Safety in Health Care BASG, which only published a “safety information” in September 2020 – no explicit warning! The Spanish manufacturer has been aware of the material defect since 2018, which led to broken arms in the womb, with pain, sometimes surgical removal – and also unwanted pregnancies.
More than 500 euros in compensation
An afflicted woman complained with the help of the VSV and in April this year the BG Fürstenfeld (Styria) was right: “A clear case of product liability”, the court ruled. It has been agreed not to disclose the amount of the compensation. That must be higher than the 500 euros that a Carinthian woman received from the BG Klagenfurt in December 2021. The SAAM has found support from a women’s organization for the women who have suffered damage. “Soroptimist Austria” has set up a crowdfunding to fund lawsuits.
Medical device warning called for reform
But the Republic must also be asked to pay in the context of an official liability case. Lawyer Margit Sagel represents some of those affected and knows: “None of my clients were aware of the material defect.” They would have believed in bad luck. The lawyer: “It wasn’t, it wasn’t enough information.” Holzinger-Vogtenhuber is calling for a comprehensive reform of the federal alert system, especially for medical devices.
