In addition to the search for other suitable accommodation, the tug-of-war over the decision announced by the municipality against setting up the emergency shelter continues with regard to the tents for asylum seekers in the Tyrolean Absam (Innsbruck-Land district). The decision of the mayor as the construction authority of first instance was pronounced on Monday. The competent federal authority wants to file a complaint.
16 young men from Syria, Somalia and Turkey were temporarily housed in the tents set up by the Federal Agency for Care and Support (BBU) on the grounds of the Wiesenhof police academy. The state of Tyrol in the person of LHStv. Georg Dornauer (SPÖ) was finally able to include asylum seekers in the country’s basic care in Kufstein. So the tents were empty for the time being. The community had previously objected to the tents through a message.
The local chief spoke of “black construction”
The requirement contained therein: The dismantling of the tents within three working days. Absam’s mayor Manfred Schafferer (SPÖ) spoke of a “black building” immediately after the tent camp was set up.
After the decision was received, the responsible federal health care agency now wants to file two complaints, the APA said.
Case before the State Administrative Court
On the one hand, as a first step, a complaint will be filed on Wednesday against the deprivation of the suspensive effect contained in the decision. In a second step, a complaint will be filed against the decision in its entirety, explains BBU spokesman Thomas Fussenegger. According to the BBU, the mayor as the competent authority is obliged to immediately submit the complaint to the Tyrolean State Administrative Court (LVwG) for decision.
“No precedent”
In order to prevent homelessness, the court must make the decision “as soon as possible,” Fussenegger said. The BBU spokesperson emphasized that the court’s decision will not set a precedent for other BBU tent shelters, as each state has its own building regulations.
“No more long fuss”
However, the Federal Support Agency made it clear again that the reception of asylum seekers in tents is currently “no alternative” because the federal states would receive too few people in their quarters and the capacity of the BBU quarters is therefore exhausted. Absam Mayor Manfred Schafferer told APA he was glad there were no people in the tents. To date, he has not yet received the complaint from the BBU, but now he does not want a “long fanfare”. This is now “a matter for the lawyers,” Schafferer said.
The chairman of the LVwG, Christoph Purtscher, said the matter would be “decided quickly” once it became available. Purtscher himself did not want to go into the facts, because it was still not clear to him what exactly was in the decision or complaint.
