Was it murder? – Leonie case: doomsday for the murdered 13-year-old

Six days later, a verdict is expected on Friday in the case of the 13-year-old who was murdered. The three accused Afghans spoke, experts gave their point of view and witnesses were heard. The charge is rape resulting in death. In an emergency situation, there is a risk of 20 years to life imprisonment. The three Afghans allegedly drugged the girl to rape her. Leonie then died of the overdose. The jury must now decide whether it was murder after all.

“Leonie completely carelessly entrusted the suspect to escape from home for a night, and they exploited that out of their own lust,” the prosecutor summarizes the night of June 25 to June 26, 2021 on day one of the trial.

Seven ecstasy pills were fatal
The night that marked Leonie’s downfall. She allegedly accompanied the three Syrians to the second defendant’s apartment. There they mixed seven ecstasy tablets – exactly MDA – into the girl’s drink. After the drugs took effect, all three allegedly raped the 13-year-old. There is a video that was shown on camera on the third day of the trial. After that it was quiet for a while between the jury and experts.

Despite the damning evidence in the form of the video, clear DNA evidence and witness statements, the defendants have pleaded not guilty to the fatal rape. All three claim to have had sexual contact with the 13-year-old, but without exception it was consensual. The second defendant also admitted this during the trial.

Was it murder?
On the last day of the hearing, lawyers Wolfgang Haas, Thomas Nirk and Andreas Schweitzer will give their closing arguments. For the first time in the process, the representatives of the private parties, Florian Höllwarth and Johannes Öhlböck, also speak. After that, the jury must decide on guilt and punishment. And isn’t it murder?
