A 14-year-old had sexual intercourse with an 11-year-old during the summer holidays. The trial in Wels ended with a guilty verdict, but no punishment – not final.
The scene of the crime was a children’s room during the long vacations: a 14-year-old Afghan allegedly sexually assaulted an 11-year-old girl who went to the same school with him in the Vöcklabruck region three times. The intercourse would have been consensual, but was still forbidden because the boy had not even been allowed to kiss the 11-year-old girl. Sex with sexual intercourse is allowed from the age of 13 at the earliest, if the partner is a maximum of 16 years old.
And the boy – as the mother of the victim of the “Krone” reported – would have urged the child via mobile phone not to report anything about the attacks. At school, the boy had to go to a “time-out class” and attempts were made to avoid meetings between those involved.
A five-year prison sentence is threatened
On Tuesday, the young Afghan, who has already reached the criminal age at the age of 14, had to answer in a juvenile court at the regional court of Wels. He risked up to five years in prison under juvenile rules. The student confessed completely.
Guilty ‘subject to punishment’
The jury found the boy guilty of serious sexual abuse, “but punishable by an observation period of three years”, court spokeswoman Gerlinde Hellebrand stated when asked by “Krone”. This means that the student can go unpunished if he follows the instructions – probation, appointments with young people and sexual counseling – and also pays the partial fee for the next three years.
The public prosecutor’s office in Wels has not yet issued a statement and the verdict is therefore not yet final.
